Brindle Purchase Agreement

USAGE RIGHTS FOR BRINDLE SOFTWARE
You are agreeing to purchase a license to use Brindle’s software (Brindle Booking, SleekAnnounce, QuickPop, Troupe, Blanket, AutoApp). Like all software, you agree that ownership of all Brindle software remains firmly under Brindle Software Inc. and that you are simply licensing use of said software within the parameters set forth by the specific plan purchased.
You may not use this software to build other software if you intend to sell it unless we agree to it in writing (feel free to get in touch if you have ideas!). However, you may alter it to fit your needs within the given parameters of your website, as needed and without limitations so long as you do not sell the end result. Any aspect of this software used as a resource for a third party plugin intended to be sold without permission from Brindle Software Inc. is a violation of this agreement, as well as copyright infringement.
Redistributing this plugin is not permitted in any way. We take piracy very seriously as it takes food from the tables of our employees. In an effort to protect our staff, we will diligently pursue those who pirate our software or otherwise use it illegally.
Your purchase of any Brindle software license subscription includes updates, and ongoing free upgrades/features that we release on a regular basis for the term of one year. At the end of your one year licensing term, Brindle subscriptions will renew automatically to ensure that your instances of Brindle products do not cease functioning.
Single License Subscription Agreement: You agree to use your copy of Brindle software on a single site only, in addition to a single staging/test environment. Single license holders may also alter the plugin files as needed, though not with the intention or final result of a product with an intent to be sold. You are free to also use this on a local test site in preparation of launching it elsewhere, with the intention that you are only using it on one live site at any given time. You may never, in any case, resell this plugin, or use any piece of it to create something with the intent of directly selling it. To ensure that your instances of Brindle software are always secure, functioning, and up to date, all licenses will conveniently renew at the end of each subscription period of one year. You can cancel or renew at any time via your account dashboard with a single click of a button.
Developer/Unlimited License: You are permitted to use Brindle software on any number of personal or client sites, however this license will remain yours only, and cannot be extended to your client (meaning, they can’t use it on their own projects). You may transfer ownership of this license to a single client, though in doing so you agree to the fact that you forfeit your right over the license and must repurchase another in order to continue using the product. Developer license holders may also alter the plugin files as needed, though not with the intention or final result of a sold product. You may never, in any case, resell this plugin, or use any piece of it to create something with the intent of directly selling it. To ensure that your instances of Brindle software are always secure, functioning, and up to date, all licenses will conveniently renew at the end of each subscription period of one year. WordPress MultiSite: Since multisite can be configured in numerous ways, there are caveats when using our software. In most cases, WordPress multi-site confugurations will require the Developer’s License to function properly.
14 day happiness guarantee: We’re really proud of our software and we’re pretty sure you’re going to love it too. To this effect, you can try it risk-free for 14 business days. Don’t like it? Simply cancel via the one-click cancellation button in your account area, and contact us for a refund, no questions asked.
You can cancel or renew at any time via your account dashboard: Subscriptions > View > Cancel. Note that an active subscription is needed for all Brindle software to properly function, and cancelling will result in the API being deactivated and the plugin to cease functioning.
Altering the code in any way may prevent us from offering support. While permitted, it is not suggested simply for the fact that it makes it harder for us to diagnose any problems that may occur. If you’re confident in your skills however, feel free to adapt it as needed as we love to see our software updated to fit different needs. Our software can be altered as needed, though not with the intention or final result of a sold product. We maintain the right to refuse tech support issues for any custom code alterations made to any Brindle products.
While we strive to offer the best support possible, we can in no way guarantee a final solution to all problems simply due to the nature of WordPress. Also due to the unlimited nature of unique builds and custom setups, it is impossible for us to guarantee that this software will work with every user’s installation, though we’re confident in the fact that it works with pretty much every WordPress solution (if we can’t provide a solution, we’ll provide a full refund if submitted within the 14 day refund period). Our software is thoroughly tested to the highest standards, and is designed to be compatible with as many setups as possible. We will strive to make it work with all customer’s sites to the best of our ability. Our biggest tip to ensure we’ll get you golden is as follows:

Our team at Brindle is promised a fair and respectful work environment, and we make it very clear that they will be treated with respect by both the staff, and our customers. Software can be frustrating, but we will respond much faster to respectful inquiries, and hold the right to completely deny service to disrespectful support inquiries in a pursuit to maintain a great work environment for our employees. We run a fun, respectful shop of multi-cultural folks, and we intend to keep it that way. In other words: Be friendly, and enjoy the process! We’re all in this together.

DUE TO THE NATURE OF DOWNLOADED SOFTWARE, THERE IS NO WARRANTY FOR THE PROGRAM, TO THE EXTENT PERMITTED BY APPLICABLE LAW. EXCEPT WHEN OTHERWISE STATED IN WRITING THE COPYRIGHT HOLDERS AND/OR OTHER PARTIES PROVIDE THE PROGRAM(S) “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESSED OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY FOR A PARTICULAR PURPOSE. THE ENTIRE RISK AS TO THE QUALITY AND PERFORMANCE OF THE PROGRAM IS WITH YOU. SHOULD THE PROGRAM PROVE DEFECTIVE, YOU ASSUME THE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION.
IN NO EVENT UNLESS REQUIRED BY APPLICABLE LAW OR AGREED TO IN WRITING WILL ANY COPYRIGHT HOLDER, OR ANY OTHER PARTY WHO MAY MODIFY AND/OR REDISTRIBUTE THE PROGRAM AS PERMITTED ABOVE, BE LIABLE TO BRINDLE SOFTWARE INC., ITS OWNERS OR ITS EMPLOYEES FOR DAMAGES, INCLUDING ANY GENERAL, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF THE USE OR THE INABILITY TO USE THE PROGRAM (INCLUDING BUT NOT LIMITED TO LOSS OF DATA OR DATA BEING RENDERED INACCURATE OR LOSSES SUSTAINED BY YOU OR THIRD PARTIES OR A FAILURE OF THE PROGRAM TO OPERATE WITH ANY OTHER PROGRAMS), EVEN IF SUCH HOLDER OR OTHER PARTY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
